1. RENTAL PERIOD: By signing this Agreement, you agree that you may have the vehicle until the return date specified in this Agreement. We may agree to extend this Agreement orally or in writing and you may need to pay an additional deposit if we agree to extend the rental. If the rental period is extended by mutual agreement, all of the terms and conditions of this Agreement shall still be binding. The pickup and return time of this agreement are estimates and might change. All requests for rental extensions must be submitted and approved at least 24 hours before the scheduled return time. Requests are subject to vehicle availability and must be confirmed by Prestige Van Rentals in writing (text or email). If the vehicle is not returned on time and no approved extension is in place the renter will be charged for one full additional day of rental at the standard daily rate,plus a $100 late return penalty, for each day the vehicle remains unreturned. Continued failure to return the vehicle may result in retrieval actions as outlined in Section 13 and possible legal consequences.

2. PAYMENT: Renters must pay the equivalent to TWO days of rental at the rate current at the time of the reservation. This payment is required to confirm the reservation, and it is applied towards the total balance. Any remaining balance is due at pick up.

3. SECURITY DEPOSIT. A $200 security deposit will be place as a hold on the card on file the day before pickup. The security deposit amount mentioned above are minimum deposits and may be increased at our discretion.

 The most common reason for this is if your travel plans include a lot of excess mileage beyond what is included in the rental agreement, or in the case the rental included 2 or more vehicles. Please note that the security deposit amount listed here may be changed without notice.

4. MILEAGE. The total free mileage included in this rental is listed in the "Rental Information" section. Rentals include 300 free miles per day. The renter agrees to pay $0.40 per mile for any mileage over this limit.

5. GAS. The Renter is responsible for refilling the gas tank of the Vehicle to the same level it had at the beginning of the rental.

6. VEHICLE CARE. Renters must not remove seats from the Vehicle. If seats must be removed to create storage space, the Renter must notify us in advance, and a Prestige Van Rentals associate will remove the seats before the pickup date. The Renter will be responsible for any damage, including but not limited to scratches and tears, caused to the Vehicle by removing seats without authorization. 

A deep cleaning fee will be charged at the company's discretion, depending on the complexity of the cleaning process after the vehicle is returned. 

7. NON-SMOKING/NON-VAPING POLICY - Prestige Van Rentals is committed to providing a safe, clean fleet for our customers. A $400.00 cleaning fee will be assessed for vehicles returned with evidence of smoking and/or vaping.

8. PET POLICY. No pets of any kind are allowed in the vehicle. Evidence of pet hair, odor, or damage will result in $a250 cleaning fee and/or cost of repair. Exceptions apply only to service animals as required by law.

9. CHILDREN SAFETY. All 12-15 passenger vans are considered passenger vehicles, therefore, the Renter is responsible for ensuring that children under age 8 and 4’9” (57 inches) ride in an approved car seat or booster seat.

10. CANCELLATIONS: Renter might cancel their reservation at any time before the pick up date. A full-day rental day will be charged in the event of cancellation.

11. EARLY RETURNS: Renter might return the vehicle at any time during their rental period. By signing this agreement, the Renter agrees that no credits/refunds will be issued for early returns.

12. INSURANCE: The Renter is required to provide proof of full coverage automobile insurance that extends to rental vehicles. The Renter's insurance policy must include Automobile Liability Insurance, Collision Insurance, and Comprehensive Insurance. The Renter is solely responsible for verifying with their insurance carrier that the policy is current and that all applicable coverages transfer to rental vehicles. Prestige Van Rentals does not provide third-party liability insurance. The Renter's personal or business automobile liability insurance is required and shall serve as the primary coverage for all bodily injury, property damage, and other third-party liability claims arising from the use of the rental vehicle. 

Prestige Van Rentals offers an optional Collision Damage Protection (CDP) plan for an additional fee, which provides coverage for eligible physical damage to the rental vehicle only, up to $35,000, subject to a $1,000 deductible. Collision Damage Protection (CDP) is not liability insurance and does not provide coverage for injuries to other persons, damage to other vehicles, damage to buildings or other property, or any other third-party liability claims. If the cost of repairing or replacing the rental vehicle exceeds the limits of the optional Collision Damage Protection (CDP), or if the damage is excluded under the terms of that protection, the Renter shall remain financially responsible for any remaining balance through their personal or business insurance and/or out of pocket. Renters who are unable to provide proof of qualifying full coverage automobile insurance that extends to rental vehicles are not eligible to rent directly from Prestige Van Rentals and may instead be eligible to rent through an approved third-party platform, where separate insurance options may be available.

13. FAILURE TO RETURN VEHICLE. Renter will return the rented vehicle to the Company’s parking storage by the expiration of the contract, or earlier if demanded be Company, together with all tires, accessories and equipment, in the same condition as when received, ordinary wear and tear expected. FAILURE TO RETURN the rented vehicle by the expiration of the contract date will result in additional charges due upon return or retrieval of the rented vehicle. After a 29 minutes grace period is over, an hourly rate of $50 will be applied up to 3 hours. If the Renter returns the vehicle 3 hours or more from the time it was rented on a subsequent day, the Renter will be charged for an additional day of rental. Failure to return rented vehicle by expiration of contract date shall be a violation of GA § 16-8-4 if this vehicle is not returned within 24 hours of the contract date, which shall result in criminal charges and fines.

14. VEHICLE RETRIEVAL. In the event that Prestige Van Rentals must retrieve a rental vehicle from a customer, the customer will be held financially responsible for all retrieval-related costs. This includes, but is not limited to a. Failure to return the vehicle by the agreed- upon return time; b. Failure to maintain or provide valid insurance coverage during the rental period; c.Unauthorized use of the  vehicle or violations of the rental agreement; d.Abandonment or failure to communicate regarding the vehicle’s location2. Retrieval Fees May Include (but are not limited to) a. Fuel surcharges and towing fees; b. Staffing and transportation costs for retrieval personnel; c. Mileage-related expenses incurred during retrieval; d. Third-party recovery services (if applicable); e. Administrative fees for contract violation; f. Any legal fees or citation processing associated with recovery 3. Immediate Action. Prestige Van Rentals reserves the right to initiate retrieval at any time if the renter is in breach of the agreement. The customer will be notified via phone, email, or text before retrieval is initiated unless the situation poses a risk to safety or vehicle security. 4. Payment and Legal Action. All retrieval costs must be paid in full within 5 business days of invoicing. Failure to pay may result in the account being sent to collections and/or pursued through legal means.

15. USE OF THE VEHICLE: By signing this Agreement, you are hereby promising that the vehicle will not be used: a. By anyone other than you or any additional driver named in this Agreement; b. By anyone not of the minimum age requirement set forth by this Agreement; c. By anyone without a full valid driving license for the class or use of vehicle rented; d. For any illegal purpose; e. For racing, pacemaking, testing the vehicle’s reliability and speed or teaching someone to drive; f. While under the influence of alcohol or drugs; g. Outside of the geographical region agreed upon in this Agreement; h. Overloaded with more passengers than seatbelts or to transport children without the legally required child safety seats; i. To propel or tow any other vehicle or trailer without prior consent; j. Other than on a paved public highway, private road or driveway; k. To transport dangerous or noxious substances; l. In a reckless or negligent manner; m. In any manner that threatens the safety of persons in or outside of the vehicle. n. for hire or taxi services including but not limited to: limousine services, charter or bus services.

16. OBLIGATIONS: By signing this Agreement, you are hereby promising that you will pay to Prestige Van Rentals LLC., on demand: a. All fines and court costs for parking, bus lane, congestion charges, traffic or other offenses assessed against the vehicle until the vehicle is returned unless those charges are the fault of Prestige Van Rentals LLC.; b. A reasonable administration fee for processing any fines or offenses against the vehicle or you as the driver of the vehicle during the rental period; c. Our costs including reasonable legal fees incurred collecting payments due from you under this Agreement; d. A reasonable collection fee if the vehicle is not returned to the original rental office indicated in this Agreement; e. A cleaning fee if you fail to return the vehicle in a reasonable condition and such charge shall be the additional cost to Prestige Van Rentals LLC. reasonably incurred as a result of such failure; f. Any recovery fees reasonably incurred by us where the damage to, or vehicle fault, is the result of human error by you, any additional driver named in this Agreement or any other person you permitted to use the vehicle and is not covered by any manufacturer breakdown program; g. In the case of damage to, loss or theft of the vehicle or any part or accessory howsoever caused to the vehicle unless caused through the fault of Prestige Van Rentals LLC., you shall pay us on demand: 1. Fair market value of the repair or replacement of the vehicle, part or accessory (as applicable) or a repair value calculated by reference to our standard list for minor repairs; 2. Reasonable administration fees; 3. Loss of revenue at the daily rate detailed in this Agreement, based on our loss of income of the vehicle, not to exceed 30 days, provided that this does not result in us being compensated twice for the same loss; 4. A reasonable sum for diminishment of value as determined by an independent Motor Engineer; 5. Any towing, storage and impound fees reasonably incurred by us as a result of the damage to, loss or theft of the vehicle. Prestige Van Rentals, shall retain the sole right and responsibility to repair the vehicle and shall, unless you as the Renter have already settled our agreed repair costs, attempt to repair the vehicle and process the insurance claim in a timely manner.; h. You are responsible for all charges, even if you have asked someone else to be responsible for them or we have billed a third party. You agree that we will compute and debit final charges from your credit card and/or debit card if that is the form of deposit or security being used to secure the rental. All charges are subject to final audit. We will use reasonable endeavors to notify you before debiting from your credit and/or debit card charges which are finalized or come to light after the end of this Agreement.; i. Where the rental of the vehicle is consequent upon your own vehicle having been involved in an accident, we may at our sole discretion permit payment of the charges due under this Agreement to be deferred for a period not exceeding eleven (11) months from the date of this Agreement. At the end of the deferment period the amount due shall become payable in one single payment and no interest charges shall be payable during, or in respect of, the deferment or credit period.; j. You are prohibited from leaving the keys inside the vehicle while the vehicle is unattended.

17. MECHANICAL FAILURES, REPAIRS, AND FLAT TIRES: a. Mechanical Failures: In the event of a mechanical breakdown not caused by negligence or misuse of the Renter, Prestige Van Rentals LLC will provide reasonable roadside assistance and/or a replacement vehicle, subject to availability. Prestige Van Rentals LLC is not responsible for incidental or consequential expenses (including lodging, travel delays, or missed activities) resulting from such failures. b. Repairs: The Renter may not authorize or perform any repairs without prior written or verbal approval from Prestige Van Rentals LLC. Unauthorized repairs will not be reimbursed and may result in additional charges if they cause further damage. If authorized, reimbursement will be provided upon submission of valid receipts. c. Flat Tires: The cost of repairing or replacing flat or damaged tires is the responsibility of Prestige Van Rentals LLC, provided the damage was not caused by reckless use or prohibited driving (see Section 14). The Renter must immediately notify Prestige Van Rentals LLC of the flat tire and may use the vehicle’s spare tire (if equipped) for temporary use until repairs are completed. Prestige Van Rentals LLC will coordinate and cover the cost of the repair or replacement. d. Renter’s Responsibility: The Renter must promptly inform Prestige Van Rentals LLC of any mechanical issue, flat tire, or need for repair. Continued operation of the vehicle after a mechanical warning (such as dashboard lights, overheating, or abnormal noises) without notifying Prestige Van Rentals LLC may result in additional damages for which the Renter will be held responsible.

18. DAMAGE AND THEFT RESPONSIBILITY: You must keep the vehicle insured against damage to, loss or theft of the vehicle up to the fair market value of the vehicle. You must comply with the terms of your insurance policy. If the vehicle is damaged, lost, or stolen, you must allow us to make a claim under any policy in your name. If the insurance you have arranged does not pay us in full for any charges, you are still responsible for paying us all outstanding charges on demand. If you have paid us everything required under this Agreement and we later recover all of our losses from a third party, Prestige Van Rentals LLC. will refund you any excess.

19. GOVERNING LAW: This Agreement is governed by the laws of the State of Georgia and any dispute shall be settled in the courts of the State of Georgia. “Dispute” shall include both contractual and non-contractual disputes. A reference to a statute or statutory provision in this Agreement is a reference to it as amended, extended or re-enacted from time to time and shall include all subordinate legislation made from time to time under that statute or statutory provision.

20. WHAT TO DO IF THE VEHICLE IS IN AN ACCIDENT OR STOLEN OR LOST: a. You must report the accident or theft or loss to us as soon as possible and confirm this in writing as soon as reasonably possible.; b. If applicable, as soon as reasonably possible you must notify your insurers and confirm to us that such notice has been given.; c. You must report the accident to the local law enforcement authorities.; d. You or any driver must not admit responsibility to anyone in relation to the accident.; e. You and any driver should contact the names and addresses of everyone involved, including witnesses, and given them to us.; f. You and any driver must promptly forward to us any notices or other documents relating to any legal proceedings arising out of the accident or theft or loss.; g. You agree to cooperate with us and our insurers including requests for full and true information and to provide assistance in any matters or legal proceedings including allowing proceedings to be brought by us in your name and defending any proceedings brought against you.; h. You must return the original keys to us and report the theft or loss to the police as soon as reasonably possible if the vehicle is stolen or lost.

21. DATA PROTECTION: A. You agree that Prestige Van Rentals LLC, may: a. Store your personal data that relates to any incident arising from your dealings with us if we think that, as a result of such incident, you could be a risk for future rentals. We may refer to such data when you contact us to seek future rental services. For example, we will record data about your failure to pay, theft of or damage to a vehicle, abusive behavior towards our staff, any relevant criminal offense committed or alleged or if you have driven under the influence of drugs or alcohol. Such data is stored separately from our general client database though the databases are linked. If we record any such data against your name and you later seek to rent another vehicle from Prestige Van Rentals LLC., the authorized Employees, at their sole discretion will decide whether the rental may proceed; b. Process any personal data given by you or obtained for the purposes of keeping of accounts and records in connection with this Agreement and its performance and, unle ss you withdraw your Agreement, our marketing generally; c. Verify personal, driving, and credit information provided by you and any additional authorized driver through credit agencies, the Motor Vehicle Division, fraud prevention agencies and databases, and any other sources; d. Provide details of any accidents in whichyou or any additional driver of the vehicle are involved to relevant insurance databases. e. You agree if you break the Agreement, we can give such of your personal data as may be relevant to various debt collectors and any other relevant organization. We can also give your information to any organizations or companies for the purposes of debt collection on balances owed to us. f. The vehicle may be equipped with a tracking device. You acknowledge that such systems utilize mobile telephone, satellite and/or radio signals to transmit data and communication and therefore privacy cannot be guaranteed. You authorize us and our appointed providers to use the access location information and automatic crash notification system and use of the vehicle location system for legitimate reasons (such as to investigate alost or stolen vehicle or to cooperate with law enforcement authorities). Prestige Van Rentals LLC., is not obliged to   or ensure the proper operation of any tracking device system in the vehicle. g. When you use any satellite navigation system in the vehicle, you are responsible for any information that is stored in the systems as a result of your use. We cannot guarantee the privacy or confidentiality ofsuch information.

 22. ENDING THE AGREEMENT: You may return the vehicle and terminate this Agreement at any time during the rental period in accordance with terms of this Agreement. We may end this Agreement immediately upon written notice to you if you commit any material breach of this Agreement. Upon termination of this Agreement, if you fail to promptly return the vehicle to Prestige Van Rentals LLC., we may repossess it, and you shall be liable for the reasonable costs involved in repossessing it. Termination of this Agreement shall not affect you or our rights and remedies which exist at the termination date. Any parts of this Agreement which by implication continue after termination shall not be affected.
